The items on the following checklist should really be researched from all possible sources and placed into a Water Rights Information Package suitable for presentation, this is best accomplished by a Water Rights Professional familiar with the variety of available sources of information and the appropriate format for a particular presentation for example: presentation of a water rights details to a potential buyer will look very different than a technical presentation made solely for the purpose of submission to either the DNRC or the Montana Water Court.  If you’d like more information please contact us:

  • Priority date(s)
  • Type of historic right (decreed, filed or use right)
  • Purpose (and irrigation type where appropriate)
  • Flow rate  -cubic feet per second – cfs (if appropriate for purpose)
  • Volume  -acre feet per year – Ac.Ft./yr (if appropriate for purpose) – many decreed rights do not reflect volume
  • Maximum acres (for irrigation, lawn and garden)
  • Source name and type
  • Point(s) and mean(s) of diversion (including reservoir specifics of appropriate) – Easement descriptions
  • Period of use
  • Place of use
  • Decrees (if any)
  • Historic use data
  • District Court actions
  • Geocode for point-of-diversion (POD) and point-of-use (POU)
  • Record of beneficial use – production records, photos, affidavits, etc.
